FinCEN FAQ: Are Family Property Transfers Reportable?
One of the most common questions we’re hearing is:
Do family property transfers trigger FinCEN reporting?
This includes situations such as:
- Adding a family member to Title
- Transferring ownership between parent and child
- Removing a family member from a Deed when no money is exchanged
FinCEN’s Residential Real Estate Reporting FAQs address these scenarios directly.
FinCEN states: “A transfer for no consideration made by an individual, either alone or with their spouse, to an individual.” (Frequently applies to parent–child transfers). FinCEN FAQ (E.3).
Additional exemptions include:
- Transfers resulting from death
- Transfers incident to divorce
Under FAQ section E.3, FinCEN clarifies that transfers between individuals with no consideration are not reportable.
Key elements of the exemption:
- The transfer is between individuals
- No consideration is exchanged
FinCEN’s Residential Real Estate rule focuses primarily on transfers involving legal entities and Living Trust structures. Family transfers that meet the exemption criteria are treated differently.

After the Close of Escrow
Even when a transfer is exempt from FinCEN reporting, it must still be properly documented and recorded.
This includes preparing the correct Deed and supporting Affidavit to ensure ownership is legally protected and accurately reflected in public records.
Errors at this stage can create Title issues later.
