The Parent Helped Buy the House. Years Later, the Parent Bought It. Does Escrow Matter?

A parent helps a child buy a home by lending money for the down payment. Years later, the child and spouse have outgrown the house and want to move into something larger. The parent likes the existing home and says, “I’ll take it over and pay off the mortgage.” Everyone agrees. No outside buyer is involved. It sounds like a simple family arrangement.

From a Title perspective, this is not simply a family handoff.

It is a complete change of ownership. The parent who originally supplied the down payment is not on Title. The child and spouse are. Their ownership interests have to be addressed, the existing mortgage has to be paid off, and ultimately the property has to be transferred into the parent’s name.

This is where families often attempt to simplify the process. Everyone knows each other. Everyone agrees on what is supposed to happen. There may not even be money changing hands in the traditional way because the parent is paying off the existing mortgage.

So why go through an escrow?

Because from a Real Estate ownership perspective, this is still a sale to the parent. In this situation, an escrow is the cleanest and smoothest way to handle the transfer. The existing mortgage can be paid off, the ownership transfer can be completed, and a new Title policy can be issued to the parent.

That coordinated process matters because the family is not simply changing who makes the mortgage payment. They are changing who owns the Real Estate and whose interest is insured. The child and spouse’s ownership interests must be addressed, the parent becomes the new owner, and the public record should reflect that change clearly. In this particular situation, the solution also included documenting the child and spouse’s intent through an Affidavit and obtaining a new Title policy for the parent.

Trust between family members can make the agreement easier. It does not make the Title transfer simpler. When ownership is changing completely, treat it like what it is: a Real Estate sale that deserves a clean transfer, a clear record, and the proper process from beginning to end.
